Research and studies in the medical field have contributed to the popularity of CBD cannabis, which have demonstrated the concrete benefits that can be derived from its use.
But which law allows the production and trade of this product?
Law 242 of 2016 regarding legal cannabis Sativa in Italy
The law n.242 of 2016, that officially entered into force on January 14th, 2017, provides for the liberalization of the production and sale of light marijuana.
This legislation promotes the support of sustainable cultivation of hemp, used in various sectors and capable of reducing the environmental impact.

These activities are protected by law 242/2016 which makes the production of weakened cannabis legitimate. But the same law does not provide for (let’s say that it does not name its own) its use for recreational purposes.

What does the Italian law say about therapeutic use?
A different case concerns the cannabis for therapeutic purposes, now legal since 2006.
Starting since 2016, its production is entrusted to the Florence pharmaceutical plant.
It can only be obtained by prescription to fight chronic pain, serious diseases such as multiple sclerosis and alleviate the side effects of chemio and radiotherapy.
It is a psychotic herb due to the high content of THC it presents.
Even legal weed, however, offers several benefits to our body: many studies have confirmed the exploitable potential to alleviate stress anxiety and the symptoms of other diseases, such as schizophrenia and depression.
Can CBD cannabis be cultivated in Italy? Do you need to get permission?
According to the law n.242 of 2016, it is possible to cultivate cannabis without encountering legal problems if the percentage of THC established by the law is respected and if weed seeds present in the register of the European Union are used.
The legislation does not provide any particular permission (except the classic commercial authorizations) to start the cultivation of light marijuana, but there are however pre-established rules to be respected.
In the event of checks, the farmer must show the cannabis seed tags to show that they are certified types and keep purchase invoices for at least one year.
It is always good to signal cultivation to the local authorities to avoid unpleasant surprises related to the doubts about the legality of their products.
In the event of an infringement, the judicial authority can arrange the seizure and destruction of the cultivation.
Uses of legal hemp
It is important to reiterate that, according to the legislation, the use of cannabis light for recreational purposes is not envisaged. Despite this, however, the hemp market is in full development.
It is possible to obtain from cultivated hemp:
- Food
- Cosmetics
- Oils (like CBD oil, which can also be used by dogs and other animals)
- Fuels
This means that the current legislation allows the cultivation and marketing of hemp for horticultural purposes, thus opening the doors to the light marijuana CBD market.
This is an important law also from the environmental point of view: hemp greatly reduces the impacts that intensive agriculture has on the soil of our territories.
Law 242/2016 on cannabis light in Italy and the regulatory gap
The 242 regulation is vague in many aspects.
The first of these concerns the use of cannabis light for personal purposes: the law explains in detail the technical uses intended for hemp, but there is no direct mention of personal consumption.
However, in Italy, respecting the laws established previously, cannabis use for recreational purposes is illegal.
There is a sort of overlap between the regulations: on the one hand, we want to expand the legal hemp market and its derivatives, but on the other, it is still difficult to buy inflorescences if not for technical or aromatic use.
It is advisable to keep the bags of CBD cannabis sealed during transport, so as not to prove that it was used if the authorities became suspicious.
Cannabis light: final reflections
Italy is currently at a difficult time regarding the subject of CBD flowers.
We hope for greater openness towards legal hemp, given the different studies that confirm the positive properties we can benefit from.
Nor should we underestimate the economic growth to which Italy will be subjected to legislation n.242 which reintroduces the cultivation of industrial hemp, supporting local industries and opening the doors to improvements and innovations for them.
